In our earlier blog, we explored the approval process for building a property,in the hillstations of TamilNadu. In line with it, in this blog, we shall look into the aspects pertaining to the site used for construction.
The governing body and rule
The site approval norms are as executed by the Municipal Administration and Water Supply Department in accordance with the Tamil Nadu District Municipalities (Hill Stations) Building Rules, 1993.
How to select land in Hill Stations at TN
Minimum Extent of Land Requirement
For construction or reconstruction of residences, the required extent of site is at least 95 sq.m with a minimum width of 6 m.
Location
· The site must be located at least 30 m away from the boundary of zones designated as being geologically weak
· The site must be approved by the government if it lies within 90 m from a place used as burning or burial ground
· The site must be approved by the Railway authorities if it lies within 30 m from the railway boundary
Utility
Permission must be sought from the District Collector in case the site is used for the construction of a place of worship or for religious purposes.
Gradient
The maximum allowable gradient of steepness, for construction of a building, is in the ratio 1:3; vertical to horizontal. If the site gradient is modified to suit the said requirement, then the stability of the site must be authorised, by a duly qualified engineer.
Soil
If the site consists of made-up soil, use of retaining walls or revetments is mandatory for protection (on the unsupported sides of the site). Also, the stability of soil must be authorised by the engineer, as suitable for building construction.
Drainage
There must be a robust storm-water drainage system in the site, to avoid flooding. This can be facilitated by draining the water into a storm-water course,or by raising the level of the site. For the latter method, layers of sturdy and non-porous material must be used, to bring the site to desired height as suggested by the executive authority. Construction of building shall be permitted only when the said system is put in place.
When will the site be refused permission for construction in hills?
Permission will not be provided in the below given cases, where the site lies
· Within 100 m from the boundaries of Sims Park at Coonoor
· Within 100 m from the boundaries of Botanical Gardens at Ooty
· Within 100 m from the boundaries of race course at Ooty
· Within 100 m from the boundaries of Gymkhana grounds at Kodaikanal
· Within 150 m from the boundaries of reserve forest / Wooded lands / areas of special interest as indicated by the government
· Within 200 m from the boundaries of lakes in Ooty and Kodaikanal
